Welcome to SpecIQ ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our AI-powered documentation generation service (the "Service") operated by SpecIQ.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the Service.

1. Acceptance of Terms

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

SpecBot AI is an AI-powered platform that generates professional documentation, including but not limited to:

  • Product specifications and technical documentation
  • Safety data sheets and compliance documents
  • User manuals and installation guides
  • API documentation and data sheets
  • Marketing descriptions and feature documentation
  • Other document types as specified in the Service

The Service uses artificial intelligence models provided by third parties (including OpenAI and Anthropic) to generate content. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

3. User Accounts and Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information to keep it accurate
  • Maintain the security of your account credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account
  • Be at least 13 years old (or the age of majority in your jurisdiction)

You may not share your account credentials with others or use another user's account without permission. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription Plans and Billing

4.1 Subscription Plans

We offer various subscription plans (Free, Starter, Pro, Enterprise) with different features, limits, and pricing. Plan details, including document limits, features, and pricing, are available on our pricing page and may be updated from time to time.

4.2 Billing

  • Paid plans are billed monthly or annually, as selected during purchase
  • All prices are in USD unless otherwise stated
  • Payment is processed through Stripe (global)
  • Subscriptions automatically renew unless cancelled
  • You authorize us to charge your payment method for renewal fees

4.3 Plan Changes

You may upgrade or downgrade your plan at any time. Upgrades take effect immediately, and charges are prorated. Downgrades take effect at the next billing cycle. No refunds are provided for downgrades or cancellations, except as specified in our refund policy.

4.4 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will continue to have access to paid features until the end of your billing period.

4.5 Refunds

We offer a 14-day money-back guarantee for all paid plans. You may cancel your subscription and receive a full refund within 14 days of your initial purchase—no questions asked.

Key Refund Terms:

  • Refund requests must be submitted within 14 days of the initial purchase date
  • Refunds are available for first-time subscriptions only (not applicable to renewals or upgrades)
  • Refunds are processed within 5-10 business days to the original payment method
  • Refunds may be denied if the account has been suspended or terminated for violation of these Terms
  • Refunds may be denied if there is evidence of abuse or fraudulent activity

4.6 Price Changes

We reserve the right to modify subscription prices. Price changes will be communicated to you at least 30 days in advance. If you do not agree to the new pricing, you may cancel your subscription before the change takes effect.

5. Usage Limits and Restrictions

Your use of the Service is subject to the limits and restrictions of your subscription plan:

  • Document Limits: Each plan has a monthly document generation limit
  • Feature Access: Certain features (bulk mode, export, custom templates) are plan-specific
  • AI Model Access: Different plans use different AI models (GPT-3.5, GPT-4, Claude)
  • Fair Use: You may not attempt to circumvent plan limits or abuse the Service

If you exceed your plan limits, you will be prompted to upgrade. We reserve the right to suspend or terminate accounts that violate usage restrictions or engage in abusive behavior.

6. User Content and Intellectual Property

6.1 Your Content

You retain ownership of any content you provide to the Service ("User Content"), including input data, product information, and specifications. By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your User Content solely to provide and improve the Service.

6.2 Generated Content

Documents generated by the Service ("Generated Content") are created using AI models. You own the Generated Content created for you, subject to the following:

  • Generated Content is provided "as-is" without warranties
  • You are responsible for reviewing and validating Generated Content
  • We do not guarantee accuracy, completeness, or compliance of Generated Content
  • You may not use Generated Content in violation of applicable laws or third-party rights

6.3 Our Intellectual Property

The Service, including its design, features, functionality, and underlying technology, is owned by SpecIQ and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our written permission.

6.4 Prohibited Content

You agree not to use the Service to generate content that:

  • Violates any applicable laws or regulations
  • Infringes on intellectual property rights
  • Is defamatory, harassing, or harmful
  • Contains malware, viruses, or malicious code
  • Is used for fraudulent or illegal purposes

7. AI-Generated Content Disclaimer

Important Disclaimer

Content generated by our Service is created using artificial intelligence and may contain errors, inaccuracies, or omissions. You are solely responsible for:

  • Reviewing and validating all Generated Content
  • Ensuring accuracy and compliance with applicable standards
  • Verifying technical specifications and regulatory compliance
  • Obtaining professional advice where necessary

We do not warrant or guarantee the accuracy, completeness, or suitability of Generated Content for any particular purpose. Generated Content should not be used as a substitute for professional advice, legal counsel, or regulatory compliance verification.

8. Prohibited Uses

You agree not to use the Service to:

  • Violate any applicable laws, regulations, or third-party rights
  • Generate content that is illegal, harmful, or violates intellectual property rights
  • Attempt to reverse engineer, decompile, or extract the Service's source code
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Interfere with or disrupt the Service or servers
  • Share account credentials or allow unauthorized access
  • Resell, redistribute, or commercialize the Service without authorization
  • Use the Service to compete with or create a competing service

9. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, for any reason, including if you breach these Terms. Upon termination:

  • Your right to use the Service immediately ceases
  • We may delete your account and data (subject to our data retention policy)
  • You remain liable for all charges incurred up to the termination date
  • Provisions that by their nature should survive termination will remain in effect

You may terminate your account at any time by contacting us or using account deletion features in the Service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPECIQ AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless SpecIQ, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that defects will be corrected. We are not responsible for the accuracy, completeness, or suitability of Generated Content.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 of India, except where prohibited by law. The seat of arbitration shall be Bangalore, India. You agree to attempt to resolve any disputes informally before pursuing arbitration.

16. Severability

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and SpecIQ regarding the Service and supersede all prior agreements and understandings.
